Tract anti-Perben: 15.000 euros d'amendes pour diffamation pour Cheminade
LYON, 5 oct 2004 (AFP) - Jacques Cheminade, président du Mouvement Solidarité
et Progrès, a été condamné mardi à payer à 15.000 euros par le tribunal
correctionnel de Lyon pour avoir fait distribuer un tract diffamant le
ministre de la Justice, Dominique Perben, a-t-on appris auprès son avocat.
Eric Sauzé, responsable du parti à Lyon et reconnu coupable de complicité,
a été condamné à payer 10.000 euros d'amende, par ce jugement rendu en
délibéré. Le procureur de la République avait requis des peines d'"amendes
assez élevées", lors de l'audience le 21 septembre, à l'encontre
de Jacques Cheminade, auteur du tract, et de M. Sauzé, organisateur de
sa distribution dans la ville. Leur avocat, Me Gilles Devers, a indiqué
qu'il réfléchissait avec ses clients à la possiblité de faire appel. Intitulé
"Vous avez dit +collaboration+?", le tract mis en cause présente
en parallèle les photos d'une poignée de main entre le ministre français
de la Justice et son homologue américain, John Ashcroft, et celle échangée
entre Adolf Hitler et Philippe Pétain à Montoire, et dénonce la loi Perben
II comme une réponse aux exigences du FBI.

Lyon, 5 oct 2004 . Jacques Cheminade, leader of the movement "Solidarité
et Pprogrès"(front group for LaRouche network), was sentenced to
pay a tax of 15000 euros at the magistrate court of Lyon for having distributed
leaflets slandering the Minister of Justice, Dominique Perben. Eric Sauzé,
who is responsible for the Movement in Lyon is recognized guilty of complicity
and was sentenced to pay 10000 euros by this decision.
The Procureur had required "quite big tax penalties" at the
meeting of 21th September, against J. Cheminade who was the author of
the leaflet, and against E. Sauzé, organizer of the distribution of the
leaflets in the city. Their lawyer, Me Gilles Devers, was looking into
the grounds for lodging an appeal.
"You say collaboration?" is the title of the photograph where
the French Minister of Justice and the American Colleague John Ashcroft
shake hands and a parallel between two photographs of a handshake between
the French Minister and his American Colleague J.Ashcroft, and A. Hitler
and Philippe Petain in Montoire ,and denounces the law Perben II as an
answer to the FBI's "exigence".
